Kim Hyun Joong and his former girlfriend known as Ms. Choi are expected to be back in court, months after the judge handed down the verdict favoring the singer. It appears that Choi filed an appeal in an effort to reverse the outcome of the case where she lost the court battle.

The first court hearing for the appeal has been set on Jan. 11, 2017. Back in August 2016, Ms. Choi was ordered by the magistrate to pay Kim the amount of KRW1.6 billion or $1.4 million after the court found her lying and falsely accusing the singer/actor of beating her which she claimed led to her miscarriage.

Choi also alleged that Kim forced her to get an abortion and this happened not once but several times while they were still a couple. Then again, the judge stated that there was no sufficient evidence to prove her claims.

TV Daily notes that although Kim won the last court battle, he was not able to prove that his ex-girlfriend threatened him with public scandal by revealing her supposed miscarriages to the media. But despite this, Choi was proven guilty for defamation instead, thus she was still ordered to pay KRW100 million or about $86,000 to Kim Hyun Joong, as compensation to the damages.

The judge based his judgment for the defamation against Choi on the TV interview she had with KBS Network. She made claims that she had miscarriage and has been pregnant not just once. Her interview is considered slander because she publicly accused Kim Hyun Joong when she has no proofs to back her claims.

Kim and Choi's legal battle started in August 2014 when the latter filed a domestic violence case against the "Break Down" singer. She later withdrew the charge and settled for huge amount of money. However, a few months after, she filed another suit against Kim.

Her case led to multiple counter-charges as Kim insists that Choi has been lying about the pregnancies because she is after his money. Barely three months after Choi filed her case against Kim, the couple was reported to have reconciled in November 2014.

By December of that year, a child was conceived and Choi gave birth in September 2015. A DNA test was performed in order to establish whether Kim is the father.

The whole case concluded in August of this year after the court dismissed all of Choi's charges vs. the singer. Simply, the court did not find proper evidence about the plaintiff's pregnancies and miscarriage claims, Soompi reported.
